The parents of a boy who died of cancer in Gandía blame to a power transformer and denounce ´governmental crime´ .

The parents of a boy who died of a brain tumor, supposedly by the magnetic fields of a power transformer located under their house, claims "patrimonial responsibility" to the Government as person in charge of "a crime of State".



Ricardo Montilla and Nicereta Herrero are the names of the parents of Jairo, a five years old child, whose disease was appeared in eight months, once a power transformer was installed underneath its house, located in the Paseo de las Germanías of Gandía, in Valencia.

The couple (attended by the lawyer Jose Luis Mazón, who gained the first condemnatory sentence on this subject of electromagnetic fields) has raised its lawsuit against the Ministries of Health, Industry and Justice, and they assure that given "the distrusts" with the Spanish Administration, the case will be presented in the Court of Strasbourg.



The lawyer adduces as argument of lawsuit sent to three departments and that Efe News Agency has had access, that Jairo "has served as human guinea pig and he is a victim of institutional laziness in relation to the dangers of the electromagnetic fields", and describes the death as "a crime of State by failure to come to the aid".

The claim by "bad operation" of the public service will also go in the judicial phase against Tiendas de Conveniencia S.A., owner of the power transformer, a branch of "El Corte Inglés".



The lawyer has formulated a mixed claim of patrimonial responsibility, that imputes jointly the Health, Industry and Justice Ministries for not fulfilled their obligations given the fact that the Spanish government has not informed the population about the risks generated by these facilities.

He understands that the Government has neglected "the precautionary principle" established by law because has not elaborated some protective norms in order to "attend the interest of the lobby of the Power Companies and have a good behaviour with the firms"


He argues that the Government has failed to satisfy his obligation "to promote the research" on the effects of the electromagnetic fields and alleges, as well " a life's omission protection", "economic ruin" of the value for sale of the house of claimers.



Mazón takes into account article 13 of the European Agreement of Human Rights, and says that the State did not defended the family of the violation of their rights to life, physical integrity, home privacy and protection of their goods.


Under the motto "Magnetic fields without low = cancer", the lawyer shows three pictures in which is appraised the remarkably transformation undergone by Jairo during the disease.



In the first picture, the boy appears apparently in a normal state when the treatment began, on 18th October 2005 , whereas in the following one, made on Fader's Day -19th March 2006, the boy has a deformed face, at this stage the boy has loosed the hair and was swollen.

The document gathers the last snapshot of the boy, 10th October 2006, with the subtitle: "The day of my burial".

The three images of Jairo, extracted from one triptych distributed by his mother, reflects, according to the lawyer, "the laziness of the State in the protection of the public health".

Mazón reveals that the State has become a "bird of prey nest", because the leaders are "frequently narcissistic of their own interests", and they "are watching to another side" when "powerful economic interests", like those of the electrical industries, commit this type of wrecks.


He concludes that dangers of magnetic fields are not a "new discovery", abundant "scientific researches" exists that associate them with damages of people's health, mainly, when there is a continuous exposition.

Los padres de un niño muerto de cáncer en Gandía culpan a un transformador y denuncian un ´crimen de Estado´


Los padres de un niño fallecido por un tumor cerebral provocado supuestamente por los campos magnéticos de un transformador de luz ubicado bajo su vivienda, exigen "responsabilidad patrimonial" al Gobierno como responsable de "un crimen de Estado".

EFE Ricardo Montilla y Nicereta Herrero son los nombres de los padres del pequeño Jairo, de cinco años, cuya enfermedad se manifestó ocho meses después de que se instalase un transformador debajo de su casa, situada en el Paseo de Germanias de Gandía, en Alicante.

El matrimonio, que ha planteado su demanda a los Ministerios de Sanidad, Industria y Justicia, asegura que "desconfía" de la Administración española y llevará su caso ante el Tribunal de Estrasburgo, asistido por el abogado José Luis Mazón, quien ganó la primera sentencia de condena por campos electromagnéticos.

El letrado aduce en la exposición de motivos, enviada a los tres departamentos y a la que ha tenido acceso Efe, que Jairo "ha servido de cobaya humano y víctima de la desidia institucional en relación a los peligros de los campos electromagnéticos", y califica el fallecimiento de "un crimen de Estado por omisión del deber de socorro".

La reclamación por "mal funcionamiento" del servicio público se dirigirá en la fase judicial también contra Tiendas de Conveniencia S.A, propietaria del transformador, y filial del Corte Inglés.

El abogado formula una reclamación mixta de responsabilidad patrimonial, que imputa conjuntamente a Sanidad, Industria y Justicia, por no cumplir sus obligaciones al no informar a la población de los riesgos que generan estas instalaciones.

Entiende que el Ejecutivo ha desatendido "el principio de precaución" legislativa, al no elaborar normas protectoras porque "es más importante llevarse bien con el 'lobby' de las eléctricas".

Argumenta que el Gobierno ha incumplido su deber de "promover la investigación" de los efectos de los campos electromagnéticos y alega, junto con la "desprotección omisiva de la vida", la "ruina económica" del valor en venta de la vivienda de los reclamantes.

Mazón se acoge al artículo 13 del Convenio Europeo de Derechos Humanos, porque el Estado no defendió a la familia de la violación de su derecho a la vida, la integridad física, la privacidad del domicilio y la protección de sus bienes.

Bajo el lema "Campos magnéticos sin ley=cáncer", el abogado muestra tres fotografías en las que se aprecia notablemente la transformación sufrida por Jairo durante la enfermedad.

En la primera aparece en estado aparentemente normal cuando empezó el tratamiento, el 18 de octubre de 2005, mientras que en la siguiente, realizada el Día del Padre -19 de marzo- de 2006, el niño tiene la cara deformada, ha perdido el pelo y está hinchado.

El documento recoge la última instantánea del pequeño, el 10 de octubre de 2006, con el pie de foto: "Día de mi entierro".

Las tres imágenes de Jairo, sacadas de una octavilla distribuida por su madre, reflejan, según el abogado, "la desidia del Estado en la protección de la salud pública".

Mazón manifiesta que el Estado se ha convertido "en nido de aves rapaces", porque sus dirigentes son "frecuentemente ególatras autistas de sus propios intereses", que "miran para otro lado" cuando "poderosos intereses económicos", como los de las industrias eléctricas, cometen este tipo de siniestros.

Concluye que los peligros de los campos magnéticos no son un "nuevo descubrimiento", ya que existen abundantes "investigaciones científicas" que los asocian con los daños a la salud de las personas, sobre todo, cuando sufren una exposición continua.
